President Trump’s Truth Social Trademark Rejected
President Trump’s Truth Social platform trademark was denied by the USPTO Thursday.
While the rejections can be eventually overcome….
This is definitely a setback for the conservative social platform.
What Was The Issue With “Truth Social”‘s Trademark?
The patent office found that Trump’s company name was “confusingly similar” to other entities, including Vero — True Social, an app-based social media platform, and the Truth Network, a Christian radio broadcast network.
Among the patent office’s concerns was that Truth Social’s name bore the “same dominant feature” — the word “Truth” — as the Truth Network. In relation to Vero — True Social, the patent office wrote that the “dominant wording TRUTH and TRUE communicate the same idea of being honest or emphasizing fact while networking socially.”
What Could Trump Have Done Differently?
Lawyer Tristan Snell who prosecuted Trump University in New York and is an MSNBC & CNN commentator tweeted the following:
Truth Social was launched 13 months after Trump left office.
Anyone can file a trademark application “before” launching, and the process usually takes around 8-12 months currently.
Trump didn’t do that. Now they got rejected –post-launch when changing the name is costly. Oops.
Any big-time business secures a trademarked name in advance of a launch — not after.
Most well-run startups do, too.
What Will Happen?
Trademark Attorney and CNBC, CNN, NPR, and ESPN contributor Josh Gerben tweeted:
The USPTO has refused Donald Trump’s trademark application for “TRUTH SOCIAL.” The basis of the refusal is the existence of multiple pre-existing “TRUTH” trademarks. Trump will have 6 months to file a response and argue against the refusal.

Is This The End of Truth Social?
No this is not likely the end of Truth Social. These rejections can be rebutted. Also, there are multiple trademark filings for Truth Social.
One of the trademarks has been accepted, published, and is pending registration.
There are also multiple other marks as well. So based on my experience, I anticipate all of these will eventually be live registered trademarks.
